The big court decision today was the Supreme Court striking down Texas’ anti-sodomy law. It wasn’t unexpected given the direction the court has been going in. And with the decision split 6-3 I didn’t even to look at the ruling to know that the three were Rehnquist, Scalia, and Thomas. More than anything this shows the importance of judicial appointments, just so that the courts don’t act like unaccountable legislatures.
