The online literary journal Dappled Things has its latest issue up and includes an essay on The Moral and Legal Obligations of Catholic Judges. It attacks the problem of whether judges are obliged to legislate from the bench or recuse themselves if the law conflicts with their Catholic beliefs. The author looks at the various issues involved and generally comes down on the side of No and Perhaps. He uses supporting material from the Summa as well as magisterial teaching.

Read the whole thing for the details of his argument. (And especially read it before commenting because it’s really annoying when people begin to argue the points when it’s obvious they didn’t bother to read what they’re arguing about in the first place!)
